TERMS AND CONDITIONS

Please read these Terms & Conditions carefully before booking any services with Worlds Converge. By making a booking, payment, or reservation, you acknowledge that you have read, understood, and agree to be bound by the terms outlined below to the fullest extent permitted by law.

Worlds Converge LLC is a registered Seller of Travel in the State of California and participates in the Travel Consumer Restitution Corporation (TCRC), registration number #2171074.

The laws of the State of California govern these Terms & Conditions.

1. Definitions

“Worlds Converge,” “we,” “us,” or “our” refers to Worlds Converge LLC.

“Traveler,” “you,” or “client” refers to any individual or group booking services with Worlds Converge.

2. Scope of Services

Worlds Converge provides:

  • Destination Management Company (DMC) services;

  • Group immersive travel experiences;

  • Independent and custom travel planning;

  • Cultural, educational, and special-interest travel programs.

All services are land-based unless otherwise specified. International and domestic airfare is not included unless explicitly stated.

Some services may be operated in partnership with independent third-party providers, including but not limited to hotels, guides, transportation companies, restaurants, activity providers, and local vendors.

3. Reservations & Payments

A booking is confirmed once:

  • A deposit is received; and

  • Written confirmation is issued by Worlds Converge.

Deposits are non-refundable unless otherwise stated in writing by Worlds Converge.

Final payment is due no later than ninety (90) days prior to the trip start date unless otherwise specified in writing.

For bookings made within ninety (90) days of departure, full payment may be required at the time of booking.

Travel documents, vouchers, confirmations, and final trip materials may be withheld until full payment has been received.

Worlds Converge reserves the right to cancel any booking that is not paid in full according to the stated payment terms.

4. Pricing

All pricing is quoted in U.S. Dollars unless otherwise noted.

Prices are based on rates in effect at the time of reservation acceptance and are subject to change due to currency fluctuations, fuel surcharges, taxes, supplier cost increases, or unforeseen circumstances until full payment is received.

Any additional costs resulting from supplier increases, government fees, currency fluctuations, taxes, or other changes beyond the control of Worlds Converge may be passed on to the traveler.

5. Payment Protection

Worlds Converge complies with applicable California Seller of Travel requirements.

Client payments will be handled in accordance with California Seller of Travel laws and any applicable consumer protection requirements.

6. Cancellation Policy

All cancellations must be submitted in writing.

Cancellation penalties are as follows:

  • More than ninety (90) days before departure: Payments received, less the non-refundable deposit, will be refunded.

  • Ninety (90) days or less before departure: No refund will be provided.

No refunds will be issued for:

  • Unused portions of a trip;

  • Voluntary early departure;

  • Missed activities, accommodations, meals, transfers, or services;

  • Failure to join the trip at the designated time and place;

  • No-shows;

  • Dismissal from the trip due to inappropriate, unsafe, or disruptive behavior.

Worlds Converge strongly recommends purchasing comprehensive travel insurance.

7. Cancellation by Worlds Converge

Worlds Converge reserves the right to cancel a trip prior to departure due to insufficient enrollment, safety concerns, supplier issues, force majeure events, or other circumstances beyond reasonable control.

If Worlds Converge cancels a trip for reasons within its control, travelers will receive a refund of payments made, less any unrecoverable costs.

If a trip is cancelled due to force majeure or circumstances beyond the control of Worlds Converge, refunds are not guaranteed and shall be limited to amounts actually recovered from suppliers, less unrecoverable expenses and administrative costs.

When feasible, Worlds Converge may offer a future travel credit or alternative travel dates, but is not obligated to do so.

8. Changes to Bookings

Requests for changes must be made in writing.

Changes may incur additional costs and are subject to availability, supplier rules, and operational feasibility.

Worlds Converge cannot guarantee that requested changes can be accommodated.

Changes requested within ninety (90) days of departure may be treated as cancellations.

9. Inclusions & Exclusions

Included services are limited to those specifically stated in the published itinerary, proposal, invoice, or written trip documents.

Unless specifically stated, the following are not included:

  • International or domestic airfare;

  • Passport or visa fees;

  • Travel insurance;

  • Baggage fees;

  • Personal expenses;

  • Laundry, phone, internet, minibar, or room service charges;

  • Meals, drinks, activities, or services not specified in the itinerary;

  • Gratuities for guides, drivers, hotel staff, or local providers;

  • Medical expenses;

  • Emergency evacuation costs;

  • Airport transfers unless specifically included.

10. Accommodations & Substitutions

Worlds Converge makes reasonable efforts to provide accommodations, transportation, activities, and services as described in the itinerary.

Travelers acknowledge that international accommodations, infrastructure, transportation, roads, utilities, service standards, and facilities may differ from those commonly expected in the United States.

Worlds Converge reserves the right to substitute accommodations, transportation, activities, guides, meals, routes, or services when necessary due to availability, safety, weather, infrastructure issues, supplier changes, or circumstances beyond our control.

When substitutions are necessary, Worlds Converge will make reasonable efforts to provide comparable alternatives where possible.

Room preferences, bedding preferences, and roommate requests will be accommodated when possible but cannot be guaranteed.

Worlds Converge is not responsible for room conditions, service interruptions, infrastructure limitations, or other circumstances beyond its reasonable control.

11. Travel Insurance

Travel insurance is strongly recommended and should include:

  • Trip cancellation and interruption coverage;

  • Medical coverage;

  • Emergency evacuation coverage;

  • Coverage for loss, theft, or delay of baggage and personal belongings.

Worlds Converge is not responsible for any costs, losses, or expenses incurred due to a traveler’s failure to obtain adequate insurance.

12. Health, Safety & Responsibility

Travelers are responsible for:

  • Ensuring they are physically and mentally fit for travel;

  • Disclosing any medical condition, mobility limitation, dietary need, or other issue that may affect participation;

  • Complying with local laws, customs, and regulations;

  • Following the instructions of guides, drivers, trip leaders, and local staff;

  • Managing their own medications, health needs, and personal safety.

Travelers certify that they possess the physical and mental capacity required for full participation in the trip.

Worlds Converge reserves the right to remove any participant whose behavior jeopardizes the safety, welfare, comfort, or experience of others. No refund will be provided in such cases.

13. Assumption of Risk

Travel involves inherent risks. By participating in a Worlds Converge trip, travelers voluntarily assume all risks associated with travel and participation.

These risks include but are not limited to:

  • Illness, injury, accident, or death;

  • Transportation by vehicles, boats, aircraft, animals, or other conveyances that may not meet U.S. safety standards;

  • Travel in areas with limited medical facilities or emergency services;

  • Exposure to unfamiliar climates, altitude, terrain, food, water, or environmental conditions;

  • Political instability, civil unrest, terrorism, crime, or government action;

  • Natural disasters, severe weather, pandemics, epidemics, or other force majeure events;

  • Infrastructure limitations, power outages, road conditions, or service interruptions;

  • Cultural differences and language barriers;

  • Actions or decisions of other travelers, guides, suppliers, or third parties.

Travelers expressly assume all risks associated with participation and agree that Worlds Converge shall not be liable for resulting claims, losses, damages, injuries, expenses, or inconvenience except as required by law.

14. Optional Activities

Optional activities, independent excursions, free-time activities, and services not expressly included in the itinerary are undertaken entirely at the traveler’s own risk.

Worlds Converge does not control and is not responsible for optional or independent activities arranged directly by travelers or third parties.

15. Travel Documents

Travelers are solely responsible for obtaining and maintaining:

  • A valid passport with at least six months validity beyond the date of travel;

  • Required visas;

  • Vaccinations or health documentation;

  • Entry, exit, and transit documents;

  • Compliance with all destination and transit country requirements.

Worlds Converge is not liable for denied entry, missed departures, delays, additional expenses, or travel disruptions caused by incomplete, expired, or invalid documentation.

16. Legal Compliance

Travelers must comply with all applicable U.S., destination country, and international laws and regulations.

Violation of laws, regulations, customs, or trip rules may result in immediate removal from the trip without refund.

Travelers agree to participate in the spirit of respectful cultural exchange, learning, and responsible travel.

17. Liability Limitations & Disclaimers

Worlds Converge acts as an intermediary in arranging transportation, accommodations, guides, meals, activities, and other travel services provided by independent suppliers.

Worlds Converge does not own, operate, manage, or control these independent suppliers and is not responsible for their acts, omissions, negligence, failures, delays, cancellations, or misconduct.

To the fullest extent permitted by law, Worlds Converge disclaims liability for any injury, loss, damage, accident, delay, inconvenience, expense, or disruption arising from:

  • Acts or omissions of independent suppliers, their employees, agents, or representatives;

  • Defects or failures in transportation, equipment, accommodations, or services;

  • Acts of God, force majeure events, or circumstances beyond reasonable control;

  • Traveler’s failure to follow instructions or participate responsibly;

  • Actions or decisions of guides, drivers, trip leaders, suppliers, other travelers, or third parties;

  • Illness, injury, accident, theft, loss, delay, or other travel-related risks.

To the fullest extent permitted by law, the total liability of Worlds Converge for any claim arising out of or relating to a trip shall not exceed the total amount paid by the traveler to Worlds Converge for that trip.

18. Indemnification

Travelers agree to indemnify, defend, and hold harmless Worlds Converge LLC, its owners, officers, employees, contractors, representatives, guides, agents, affiliates, and partners from and against any claims, demands, losses, liabilities, damages, costs, or expenses, including reasonable attorney fees, arising out of or related to:

  • The traveler’s participation in the trip;

  • The traveler’s conduct, negligence, or misconduct;

  • The traveler’s failure to follow instructions;

  • The traveler’s violation of these Terms & Conditions;

  • The traveler’s violation of any law, rule, regulation, or third-party right.

19. Force Majeure

Worlds Converge is not responsible for delays, changes, cancellations, losses, damages, expenses, or inconvenience caused by events beyond its reasonable control.

Force majeure events include but are not limited to:

  • Natural disasters;

  • Severe weather;

  • War, terrorism, or civil unrest;

  • Pandemics, epidemics, or public health emergencies;

  • Government actions, restrictions, border closures, or advisories;

  • Transportation disruptions;

  • Strikes or labor disputes;

  • Supplier failures;

  • Infrastructure failures;

  • Any other event beyond the reasonable control of Worlds Converge.

In the event of force majeure, refunds are not guaranteed. Any refund shall be limited to amounts actually recovered from suppliers, less unrecoverable expenses and administrative costs.

Worlds Converge may, at its discretion, offer postponement, future travel credit, or alternative arrangements when feasible.

20. Itinerary Changes

Worlds Converge reserves the right to modify itineraries, schedules, accommodations, transportation, activities, meals, guides, and routes due to circumstances beyond its control, operational needs, supplier changes, or in the interest of traveler safety and experience.

Reasonable efforts will be made to provide comparable alternatives where possible.

Itinerary descriptions are provided in good faith but are not guarantees of exact timing, routing, activities, or conditions.

21. Baggage & Personal Belongings

Travelers are responsible for their personal belongings at all times.

Worlds Converge is not liable for lost, stolen, delayed, or damaged baggage, personal property, travel documents, money, electronics, or valuables.

22. Photography & Media

Worlds Converge may use photographs, video, or other media taken during trips for promotional, educational, social media, and marketing purposes.

Travelers grant Worlds Converge a perpetual, royalty-free right to use such images and recordings unless they notify Worlds Converge in writing prior to departure that they do not wish to be included.

23. Intellectual Property

All itineraries, travel designs, written materials, program concepts, descriptions, documents, and related content created by Worlds Converge remain the intellectual property of Worlds Converge.

Such materials may not be copied, reproduced, distributed, adapted, or used for commercial purposes without prior written consent.

24. Complaints & Claims

Any concerns should be raised during the trip so that Worlds Converge has a reasonable opportunity to address them.

Formal complaints must be submitted in writing within thirty (30) days following completion of the trip.

Any legal claim against Worlds Converge must be filed within one (1) year of the conclusion of the trip or shall be forever barred to the fullest extent permitted by law.

25. Dispute Resolution

These Terms & Conditions are governed by the laws of the State of California, without regard to conflict of law principles.

Any disputes, claims, or legal proceedings arising out of or relating to these Terms & Conditions, the trip, or services provided by Worlds Converge shall be resolved exclusively in the state or federal courts located in California.

Travelers consent to the jurisdiction and venue of such courts.

To the fullest extent permitted by law, travelers waive the right to participate in any class action, collective action, or representative proceeding against Worlds Converge.

26. Severability

If any provision of these Terms & Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.

27. Entire Agreement

These Terms & Conditions, together with the applicable itinerary, invoice, proposal, registration form, and written trip documents, constitute the entire agreement between the traveler and Worlds Converge.

These Terms & Conditions supersede all prior discussions, understandings, representations, or agreements, whether written or oral.

28. Amendments

Worlds Converge reserves the right to update or amend these Terms & Conditions at any time.

Updated terms will be posted on the Worlds Converge website and shall become effective upon posting.

Any changes to a confirmed booking must be made in writing.

29. Binding Effect

By making payment, submitting a reservation, signing a registration form, or participating in any Worlds Converge trip or service, travelers acknowledge that they have read, understood, and agreed to be bound by these Terms & Conditions.

30. Survival

The provisions concerning liability limitation, assumption of risk, indemnification, dispute resolution, intellectual property, and claims shall survive completion of the trip.
